Terms of Service

Job Estimator (“the Service”) is a software platform operated by Job Estimator LLC (“we”, “us”) that helps tradespeople generate, send, and track customer quotes. We may update, change, or discontinue features over time.

You must provide accurate information when you sign up and keep it current. You are responsible for everything that happens under your account, including the actions of anyone you let use it. Keep your password secure; tell us promptly if you suspect unauthorized access.

You must be at least 18 years old and have the authority to bind your business (if you sign up on behalf of one).

Paid plans are billed in advance on a monthly or annual cadence. Trials require a card on file. After the 14-day trial, your card is charged automatically for the plan and cadence you picked at signup, and on every renewal thereafter.

Prices are listed on our pricing page. We may change prices with at least 30 days' notice — changes apply to your next renewal, never retroactively. Taxes are added where required. All fees are non-refundable except where required by law.

If a payment fails, we will retry and notify you. If we cannot collect after a reasonable period, we may suspend or terminate your account.

You can cancel any time from your billing settings. You keep full access until the end of your current billing period. After that, your account flips to a 30-day read-only window so you can export your data, then it is scheduled for deletion.

You agree not to:

• use the Service to send spam, harass anyone, or violate any law;
• upload content you do not have the right to share, including customer information you do not have permission to process;
• attempt to break, probe, or reverse-engineer the Service, or interfere with other users;
• resell, white-label, or sublicense the Service without our written permission;
• use automated tools to extract data, or use the Service in a way that imposes an unreasonable load on our infrastructure.

We may suspend or terminate accounts that violate these terms.

You retain ownership of the job notes, customer information, quotes, and other content you upload (“Your Content”). You grant us a limited license to host, process, and transmit Your Content for the sole purpose of providing the Service to you.

You are responsible for the accuracy of quotes you send to your customers. The Service helps you draft quotes, but the numbers, scope, and any commitments are yours.

The Service uses third-party AI models (currently OpenAI) to generate draft quote line items and transcribe voice notes. AI output may be inaccurate or incomplete. You are responsible for reviewing and approving every quote before sending it. We make no warranty as to the accuracy of AI-generated content.

The Service, including its software, design, and content (other than Your Content), is owned by Job Estimator LLC and is protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service while your account is in good standing.

The Service relies on third parties (Stripe for billing, OpenAI for AI, Resend for email, Twilio for SMS, Supabase and Vercel for hosting). Their availability and behavior are outside our direct control. Their terms apply to their parts of the Service.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOB ESTIMATOR LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You agree to defend and indemnify Job Estimator LLC against any third-party claim arising from Your Content, your use of the Service in violation of these terms, or your violation of applicable law.

You may stop using the Service at any time by cancelling your subscription. We may suspend or terminate your account if you breach these terms, fail to pay, or for any reason on at least 30 days' notice. On termination, sections that by their nature should survive (ownership, disclaimers, liability limits, governing law) survive.

We may update these terms from time to time. If changes are material we will notify you by email or in the product at least 30 days before they take effect. Continued use after the effective date means you accept the updated terms.

These terms are governed by the laws of the jurisdiction in which Job Estimator LLC is registered, without regard to conflict of laws principles. Disputes will be resolved in the courts of that jurisdiction unless local consumer protection law requires otherwise.
